DRAFT LAW OF PLANNING, USE AND MANAGEMENT OF THE LAND

The draft Law of Land Use and Management, which was sponsored by Assemblyman Richard Calderon and approved by the plenary of the National Assembly on May 13, 2016, is in its final stage of approval. To date, it awaits veto or sanction of the President of the Republic. The main objective of the approved project is the regulation of the planning competency and land management by municipal and metropolitan autonomous governments, and specifically with regard on how to manage the uses of urban and rural land. While it is true that between the objectives of the bill are provisions that reach other levels of government, there is no doubt that the highlight of the project is the abovementioned statement.

In the 20th Century there was a debate about the level of protection that should accrue to foreign investors. Developed states demanded a “minimum treatment” standard of protection. The developing countries, in turn, demanded a standard of equal treatment between nationals and foreigners. In the end, developed countries were able to impose their doctrine. Here we are going to go over the differences between these two doctrines, and afterwards we will highlight the relevance of this distinction for Ecuador.
