Amendments to Fair Work Act passed

On 4 December 2012, the Federal Government enacted the Fair Work Amendment Act 2012 (Amendment Act), which implements a number of recommendations of the Fair Work Act Review Panel's recommendations in relation to the Fair Work Act 2009 (FW Act) and the Productivity Commission's Report into Default Superannuation Funds.

The principal changes to the FW Act brought about by the Amendment Act are set out in this update.

The Fair Work Amendment (Transfer of Business) Act 2012 was also passed, providing for the transfer of public sector employment conditions where there is a transfer of business from a state-based employer to a national system employer. The transfer of business changes took effect on 5 December 2012.
